Welcome to the Klamath Lodge #77, F&AM website (the "Site"). These Terms of Service ("Terms") govern your access to and use of our Site. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

Klamath Lodge #77, F&AM ("we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Site after changes indicates your acceptance of the updated Terms.

1. Acceptable Use Policy

You agree to use our Site only for lawful purposes and in accordance with these Terms. You agree not to:

1.1 Prohibited Activities

• Use the Site in any way that violates federal, state, or local laws or regulations
• Engage in conduct that is defamatory, obscene, abusive, harassing, or threatening
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Submit false, misleading, or fraudulent information through forms or communications

• Introduce viruses, malware, or other malicious code that may damage or disrupt the Site
• Use automated systems (bots, scrapers, crawlers) to access the Site without our express written permission

1.2 Masonic Conduct Standards

Users who identify as Freemasons are expected to conduct themselves in accordance with Masonic principles of brotherly love, relief, and truth. Violations of Masonic conduct standards may be reported to the Grand Lodge of Oregon.

2. Intellectual Property Rights

2.1 Site Content Ownership

Unless otherwise indicated, the Site and all content, features, and functionality (including but not limited to text, graphics, logos, images, photographs, videos, and software) are owned by Klamath Lodge #77, F&AM or licensed to us and are protected by United States and international copyright, trademark, and other intellectual property laws.

2.2 Trademarks

The Klamath Lodge #77 name, logo, Square and Compasses symbol, and other marks displayed on the Site are registered trademarks or trademarks of Freemasonry, the Grand Lodge of Oregon, and Klamath Lodge #77. You may not use these marks without our prior written permission.

2.3 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not:

• Reproduce, distribute, modify, or create derivative works from any Site content without our express written permission
• Use Site content for commercial purposes or public display (commercial or non-commercial)
• Remove or alter copyright, trademark, or other proprietary notices from Site content
• Frame or mirror any portion of the Site on another website or platform

2.4 User Submissions

If you submit content to the Site (e.g., membership applications, contact form messages, event registrations), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, and publish such content for the purposes of operating the Site and providing services to you.

3. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE FULLEST EXTENT PERMITTED BY LAW, KLAMATH LODGE #77, F&AM AND ITS OFFICERS, TRUSTEES, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:

• Your access to or use of the Site
• Your inability to access or use the Site due to downtime, errors, or technical issues
• Any content, information, or services obtained through the Site
• Unauthorized access to or alteration of your transmissions or data
• Any errors, omissions, or inaccuracies in Site content or communications
• Any conduct or content of third parties on or through the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, INCLUDING NEGLIGENCE, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE (WHICH IS TYPICALLY $0).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

5. Indemnification

You agree to defend, indemnify, and hold harmless Klamath Lodge #77, F&AM and its officers, trustees, members, employees, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Site, including any content you submit or transmit
• Your violation of any law, regulation, or third-party rights
• Any misrepresentation made by you in your use of the Site

The Site may contain links to third-party websites, services, or resources (e.g., Grand Lodge of Oregon, Masonic charities, NetworkReef). These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be liable for any damage or loss caused by or in connection with your use of third-party websites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

7. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the data practices described in our Privacy Policy.

8. Termination

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct that we deem harmful to the Site, other users, or the lodge.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Oregon, United States of America, without regard to its conflict of law provisions.

9.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in Klamath County, Oregon. You irrevocably consent to the personal jurisdiction and venue of such courts.

9.3 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Klamath Lodge #77, F&AM regarding your use of the Site and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral, written, or electronic) between you and us.

12. Changes to These Terms
